Uncontested divorce in New York

An uncontested divorce is one where both spouses agree to end the marriage and agree on the terms: property, debts, support and, if there are children, custody and child support. We prepare the agreement and the court papers so the case can be decided without a trial.

What New York requires

  • Residency New York has residency rules in Domestic Relations Law §230. One common route is that either spouse has lived in New York for two continuous years before filing. Shorter periods can qualify in some situations.
  • Grounds Most uncontested cases use the no-fault ground in DRL §170(7): one spouse states under oath that the relationship has been irretrievably broken for at least six months.
  • Agreement All issues must be resolved in writing before the judgment can be signed. That includes property, maintenance, custody, child support and counsel fees.
